Terms of Service

Terms of Service
Conxxus Terms of Service for Fiber to the Home

Effective October 2026

These Terms of Service (“TOS”) set forth the terms and conditions for residential fiber-to-the-home (“FTTH”) services (“Services”) provided by Metro Communications Asset Entity, LLC, a subsidiary of MCC Network Services, LLC d/b/a Conxxus (“Conxxus”), an Illinois limited liability company headquartered at 8 S. Washington Street, Suite 200, Sullivan, IL 61951. By ordering or using the Services, you agree to these TOS and the applicable service terms and policies referenced below. You may cancel the Services at any time, for any reason. Conxxus may terminate the Services at any time, for any reason or no reason, subject to applicable law and any required notice. There is no minimum service commitment, even if you select a plan with a one-year or three-year price guarantee. Conxxus may update these TOS as described under “Changes to These TOS.” If you do not agree to an update, you may cancel the Services.

Availability of Content and Services

Conxxus may use reasonable network-management practices to maintain the security, integrity, capacity, and operation of its network, as described in its Network Management Policy at https://conxxus.com/legal/network-management-policy. We may restrict traffic or content when reasonably necessary to address unlawful activity, a security threat, network harm, or a lawful order.

Responsibility for Content

You are responsible for content you create, store, or transmit using the Services and for activity using your account, subject to applicable law. Conxxus does not create or control third-party content available over the internet and is not obligated to review it. We may investigate suspected violations of these TOS or the Acceptable Use Policy (“AUP”) and take action authorized by those policies and law. We may cooperate with lawful requests from public authorities.

Termination

You may cancel the Services at any time and for any reason by contacting our Customer Service department at support@conxxus.com or 888-712-0177. Conxxus may suspend or terminate the Services at any time, for any reason or no reason, subject to applicable law and any required notice. Where required, we will provide notice and an opportunity to cure before terminating for nonpayment or another remediable reason. We may act promptly when legally permitted to address fraud, unlawful use, a serious security or safety threat, or a lawful order.

Recurring charges stop as of the time of disconnection. You remain responsible for charges accrued through that date and any properly disclosed final charges, including a conditional installation charge under an applicable one-year plan. Returning equipment does not extend recurring Service charges after the effective disconnection date. Any prepaid amount, credit, or refund will be handled under the Billing Policy and applicable law.

You must stop using company-owned equipment after Service ends and return it within 30 days. You can arrange for a pick-up by calling 888-712-0177 or you may drop off the equipment at 8 S. Washington St., Sullivan, Illinois 61951. You will be charged a lost equipment fee if equipment is not returned within 30 days.

Prices Billing and Payment

Your order or plan confirmation identifies your selected Service, monthly price, applicable price-guarantee period, and any installation, equipment, or other one-time charges. A one-year or three-year price guarantee does not require you to keep Service for that period. We do not assess a general early termination fee for canceling during it.

If you choose an eligible one-year plan, the standard $150 installation charge is conditionally waived: if you cancel before the one-year period ends, or Conxxus terminates during that period because of your nonpayment or material breach, the waiver no longer applies and the $150 charge is due on the final bill. If you choose an eligible three-year plan, the installation charge remains waived regardless of when you cancel. Conxxus will not revoke the one-year waiver when it ends Service for its own convenience.

The Billing and Payment Policy at www.conxxus.com/legal states billing cycles, due dates, payment methods, late charges, returned-payment charges, billing disputes, suspension and reconnection procedures, credits, and refunds.

Acceptable Use Policy

You agree to comply with the Conxxus AUP at www.conxxus.com/legal/AUP, which is incorporated into these TOS. You may not use the Services to violate law, infringe others’ rights, send spam, distribute malicious code, commit fraud, gain unauthorized access, or materially interfere with the network or other users. You are responsible for activity using your account, but Conxxus will not hold you responsible for conduct caused solely by its own acts or omissions.

Inappropriate Harmful and Fraudulent Content

You may not knowingly use the Services to transmit or store unlawful content, malicious code, or fraudulent or materially deceptive communications, or to threaten or harass others in violation of law. You may not provide false material information to establish an account or use another person’s payment credentials without authorization. The AUP sets out additional examples and Conxxus’s response to violations.

Monitoring by Conxxus

Conxxus may operate, troubleshoot, protect, and manage its network and systems, investigate suspected abuse, and comply with lawful process as described in its Privacy Policy and Network Management Policy. These TOS do not authorize unrestricted monitoring of the contents of customer communications.

Unsolicited Messages

You may not use the Services to send unlawful or unsolicited bulk messages, forge message headers, distribute malicious messages, or continue sending messages to a recipient who has asked you to stop. Additional rules appear in the AUP.

Intellectual Property and Website Materials

You may not use the Services to infringe or misappropriate another person’s intellectual property. Conxxus and its licensors retain their rights in the Conxxus name, marks, website, and materials. These TOS do not grant you the right to use Conxxus marks except as needed to identify your Service.

Takedown and Enforcement

If Conxxus reasonably determines that content or use of the Services violates law, these TOS, or the AUP, it may take proportionate action, including disabling access to particular material where technically feasible, restricting use, or suspending or terminating Service. Conxxus may act without advance notice where needed to prevent imminent harm or comply with law. A copyright complaint will be handled under the DMCA process described below.

Indemnification

To the extent permitted by law, you will indemnify Conxxus against third-party claims directly arising from your unlawful use of the Services or your infringement of another person’s intellectual property, except to the extent caused by Conxxus. Conxxus will give you reasonable notice of the claim and may participate in its defense.

Disclaimer of Warranties

Except for express promises in an applicable order or Service term and warranties that cannot lawfully be excluded, Conxxus does not guarantee uninterrupted, error-free, or secure Service, a particular activation date, or compatibility with all customer devices and applications. Internet speeds and performance may vary as disclosed in the applicable plan information and Network Management Policy. Conxxus is not responsible for third-party websites or content it does not control. Nothing in this section limits duties or remedies that cannot be excluded under applicable law.

Limitation of Liability. To the fullest extent permitted by applicable law, neither party is liable to the other for indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or relating to the Services or these Terms, regardless of the legal theory asserted and even if advised of the possibility of such damages.

Conxxus’s aggregate liability for all claims arising from the same event or related events will not exceed the recurring charges paid or payable by Customer for the affected Service during the three months immediately preceding the event giving rise to the claim. If the affected Service has been provided for fewer than three months, the cap will equal three times the monthly recurring charge applicable when the event occurred. Taxes, installation charges, and other one-time charges are excluded when calculating this cap.

The foregoing exclusions and cap do not apply to liability arising from Conxxus’s gross negligence, willful misconduct, or fraud; bodily injury, death, or physical damage to tangible property to the extent caused by Conxxus’s negligence; or any liability, statutory damages, or other remedy that cannot lawfully be limited or excluded, including under applicable privacy or data-protection laws.

Service credits apply as provided in the applicable Service terms or Billing Policy. This limitation does not reduce any credit, refund, or correction of an erroneous charge otherwise owed to Customer. Customer may not recover twice for the same loss. Nothing in this section excuses Customer’s obligation to pay properly assessed charges or limits Customer’s indemnification obligations under these Terms, subject to applicable law.

Reselling

You may not resell or redistribute residential Service outside your household or service address without Conxxus’s written authorization. Ordinary use by household members and guests is permitted.

Customer Information and Security

Conxxus handles Customer Proprietary Network Information (“CPNI”) and other protected customer information in accordance with applicable law and its Privacy Policy at https://conxxus.com/legal/privacy-policy. You should use reasonable measures to secure your account credentials, devices, and home network. Conxxus will provide the security features, if any, promised with your purchased Service or protection plan.

Export Laws

You may not use the Services in violation of applicable U.S. export-control or sanctions laws.

911 and E911 Acknowledgment

If you purchase Conxxus voice Service, you acknowledge that its 911 functions may differ from traditional wireline service and may depend on power, equipment, connectivity, and the accuracy of your registered location. The applicable limitations and your responsibilities are described in the E911 Disclosure at https://conxxus.com/legal/E911-disclosures. You must inform other users of those limitations and maintain an alternate means of calling 911 as described in that disclosure.

Privacy

The Conxxus Privacy Policy at https://conxxus.com/legal/privacy-policy describes information practices relating to the Services.

Text Messaging

If you separately opt in to optional account and service text messages, the SMS Terms at https://conxxus.com/legal/sms-text-messaging apply. Message frequency varies, and message and data rates may apply. You may opt out by replying STOP or by using the other methods described in the SMS Terms. Consent to optional text messages is not a condition of purchasing Service.

Digital Millennium Copyright Act

Conxxus handles copyright notices and counter-notices under its DMCA Policy at https://conxxus.com/legal/DMCA

Stored Data and Telephone Numbers

If Conxxus provides you with a hosted email, voicemail, website, or storage feature, the applicable Service terms will state what happens to that feature and its stored data after Service ends. You should preserve data you wish to keep before disconnection. If you want to retain a telephone number, request a transfer before disconnecting voice Service; Conxxus will process eligible porting requests under applicable law.

Force Majeure

Neither party is responsible for a failure or delay caused by events beyond its reasonable control, including severe weather, fire, cable cuts, power failure, government action, or labor disruption, to the extent the affected party uses reasonable efforts to reduce the effect. You remain responsible for charges accrued for Service provided before the event.

Changes to These TOS

Conxxus may update these TOS prospectively. We will provide or post a notice of a material change at least 14 days before it takes effect, unless a different process is required or permitted by law for an urgent change. You may cancel the Services at any time if you do not agree to a change. A change will not retroactively alter charges already accrued or an applicable price guarantee except as permitted by its terms and law.

Governing Law and Disputes

These TOS are governed by the laws of the state of Illinois, except where federal law or another jurisdiction’s nonwaivable law applies. Before filing a claim, you may contact Conxxus’ Legal Department at legal@metrocomm.com or 888-712-0177 to seek a resolution; this does not limit rights to contact a regulator or bring a claim. You agree that all legal actions will be brought in Moultrie County, Illinois.

Assignment and General Provisions

You may not transfer your account without Conxxus’ consent. Conxxus may assign its rights and obligations to an affiliate or successor that assumes them. If a provision of these TOS is unenforceable, the remaining provisions continue to apply to the extent they can operate as intended. Failure to enforce a provision once does not waive the right to enforce it later. These TOS, the applicable order and Service terms, the Billing Policy, and the AUP state the terms governing your use of the Services; they do not require you to keep Service for a minimum period.

UNIVERSAL PRICE PLAN TERMS AND CONDITIONS

These Universal Price Plan Terms & Conditions (“Terms”) apply to eligible residential service plans (each, a 1-year or 3-year Universal Price Plan) offered by Metro Communications Asset Entity, LLC, a subsidiary of MCC Network Services, LLC d/b/a Conxxus (“Conxxus”) that are advertised or described as including a universal pricing feature (the “Offer”). These Universal Price Plan Terms are incorporated into and made part of Conxxus’ General Terms of Service. By enrolling in a Universal Price Plan, you agree to these Terms in addition to Conxxus’ General Terms of Service.

Universal Price Plan

Under the Universal Price Plan, Conxxus will not increase the monthly service fees for your account during the committed Term, either for 1 year or 3 years, except for:

· Government-imposed fees, taxes, or surcharges that change by law or regulation.

· Discretionary one-time charges you incur (for example, late fees, returned payment charges).

· Equipment purchase charges, increases in speed or other value-based add-ons.

The Universal Price Plan offer applies only to the base monthly recurring service charge for the eligible 1 or 3 year Plan, and does not guarantee:

· Promotional bill credits beyond their stated promotional period.

· Third-party service charges, content subscriptions, or other bundled services that may be subject to separate terms and prices.

Universal Price Plan Term

The Universal Price Plan term is the pricing period applicable to the plan you select. The term begins on the later of the date of your service is activated or the Universal Price Plan is added to your account and continues for either 1 or 3 years, depending on the plan selected. The consequences of cancellation before the end of the Term are described below.

Eligibility and Enrollment

The Universal Price Plan is available only for residential Internet service at a qualifying Conxxus service address. Enrollment may occur when you order service under a Universal Price Plan.

Installation Fee Waiver

Conxxus’ standard $150.00 installation fee applies when Service is installed. If you selected the 1 Year Plan and cancel your Service before the end of that 1 Year Term, or Conxxus terminates Services during that Term because of nonpayment or other material breach, the conditional installation fee waiver will be revoked and the standard $150.00 installation fee will be charged on your final bill. If you selected the 3-Year Plan, the installation fee is unconditionally waived and will not be charged, regardless of when you cancel your Service.

Amendments and Changes to the Universal Price Plan

Conxxus may discontinue the Universal Price Plan offer for new customers at any time or modify the terms of future Universal Price Plan offerings, provided that such changes will not increase your agreed monthly service fee or alter the Installation Fee Waiver terms applicable to your current 1-Year or 3-Year Term, except as specifically required by law.
